DETAILS OF MY CASE
On September 5th, 1991, while I was over a hundred miles away in Oklahoma City with my father who was being treated for terminal cancer, Juanita and Sherry Cummings shot and killed Judy Ann Moody Mayo, my sister and killed her 11 year old daughter Melissa Marie Moody.
Both Judy & Melissa disappeared while I was in Oklahoma City. Judy & Melissa were last seen at the Potters home in Coalgate, Oklahoma at 1:15 the afternoon of September 5th, 1991. The case remained open and unsolved from September 1991, until July 1994.
On July 27th, 1994, the day before I was arrested, Juanita decided to disclose to me for the first time that she was the one who shot and killed my sister Judy and the one who took my niece Melissa and did away with her back in 1991.
On July 28th, 1994, Juanita went to work and decided to talk to her employer Edward Fields and his wife Deane. Juanita told them that when she returned home from work September 5th, 1991, that Judy's body was gone and so was Melissa's. Juanita was home long before I returned from Oklahoma City. In the first interview with police after talking to Fields, Juanita said much the same thing, stating that she did not know who killed Melissa. But by the time of the trial, Juanita's story had changed substantially.
Juanita & Sherry testified that Judy was murdered in my home. Judy's body was found on September 9th, 1991 in Atoka County in a pond next to Atoka Lake. Judy's body was left in the pond unti September 10th, 1991 before Law Enforcement removed her body. Judy had been shot several times. Luminal blood testing was done on my home March 3rd, 1992 by law enforcement. There was no evidence, physical, trace or biological to support that Judy was shot and killed in my home as claimed in testimony by Sherry & Juanita. There are many material inconsistencies between the women's versions of how it came about that Juanita shot Judy to death.
Melissa's skeletel remains were recovered on October 16th, 1991 near a bridge spanning the clear boggy creek in Choctou County. The medical examiner released Melissa's body and she was buried on November 22, 1991. Initially the medical examiner was unable to determine a cause of death for Melissa. However, some time years later, her remains were exhumed for a second autopsy at which time evidence of sharp force trauma on several ribs were discovered.
The prosecutions theory of the case, as presented through the testimony of Sherry & Juanita was that I was responsible for both murders. I was convicted based solely on the testimony of Sherry & Juanita Cummings. Both women testified pursuant to plea bargains to keep from receiving the death penalty. But they had to satisfy the prosecution with their testimony before being able to receive their plea bargains. There is no physical evidence connecting me to either of these killings. None of the evidence was tested by the prosecution or by my defense counsel to determine whether the hair samples and blood tracings could be tested for DNA in order to compare the results with my DNA or any other suspects. A review of the trial transcripts and exhibits reveals that there is no evidence, either testimonial, documentary or forensic, linking me to the homicides aside from the the words of Sherry & JUanita. The evidence shows that Sherry's and Juanita's testimonies have repeatedly been inconsistent with one another's and with the testimony of other witnesses. The prosecution used false evidence and suppressed material evidence that denied me a fair trial.
